Presshouse Terms of Service

These terms are an agreement between you and Intentionally Creative LLC for your use of presshouse.app and build.presshouse.app and the Presshouse service. Please read them; using Presshouse means you accept them.
The short version
- You can use Presshouse for your business or your own projects as long as you follow these terms and our Acceptable Use Policy.
- You own what you put in and what Presshouse makes for you. We use it only to run the service for you, as our Data Processing Addendum describes.
- Presshouse uses AI. Check its work before you rely on it; important actions wait for a person's approval.
- You pay with credits. A job is charged only when it succeeds. Our Credits and Refunds page has the details.
- Disputes are handled under New York law, and you keep every consumer right the law where you live gives you.
Who we are
Presshouse is operated by Intentionally Creative LLC, a New York limited liability company doing business as Presshouse, a Get Creative company ("Presshouse", "we", "us"), at 4465 E Genesee St., Syracuse, New York 13214, United States. You can reach us at support@presshouse.app.
Who can use Presshouse
You must be at least 18 and able to form a binding contract. If you use Presshouse for a business, you confirm you have authority to accept these terms for it, and "you" includes that business.
Your account
Keep your sign-in details safe and tell us right away at support@presshouse.app if you think someone else has used your account. You are responsible for what happens in your account, including what members you invite do there. Give us accurate information and keep it current.
The service
We provide Presshouse as it exists at the time you use it, and we improve it continuously. We may add, change or remove features. If we remove a feature you pay for in a way that materially reduces what you get, we will tell you in advance and you may cancel and receive a prorated refund for the unused period.
Credits and payment
- Credits. You buy credit packs at the prices shown when you buy. Each action (for example a brand guide, a first build, a revision or an image) costs the number of credits shown before you start it.
- Charged on success. Credits are held when a job starts and charged only when it finishes successfully. A job that fails returns its credits.
- Free credits we give at sign-up or as a promotion have no cash value and may expire as stated when given.
- Payment is processed by Stripe. Prices are in US dollars and include any taxes we are required to collect, unless shown otherwise.
- Refunds are covered by our Credits and Refunds page.
Your content
You own your content: everything you or your team put into Presshouse and everything Presshouse produces for you, including your brand guides and websites, subject to the rights of others in material you supply.
You give us a limited license to host, copy, process, transmit and display your content only as needed to run and support the service for you, to keep it secure and to comply with the law. That includes sending it to the service providers listed in Service Providers and Subprocessors. We do not sell your content. Where your content includes personal information about other people, our Data Processing Addendum forms part of these terms and governs how we process it.
We may use aggregated or de-identified information that does not identify you, your business or anyone in your content to operate and improve our products.
You are responsible for your content: that you have the rights and permissions to use it, that it is lawful, and that you have given any notices and obtained any consents needed to put other people's information into Presshouse.
Feedback. If you send us ideas or suggestions, we may use them without owing you anything.
AI features
Presshouse uses AI to read, write, speak, design and take actions for you. AI can be wrong, incomplete or out of date, and it can produce output that resembles other people's work.
- Review before you rely. Check AI output before you publish it, send it or act on it. Presshouse asks a person to approve important actions, such as sending messages to customers, and you are responsible for what you approve.
- Not professional advice. Presshouse does not give legal, tax, financial, medical or insurance advice.
- Telling people they're talking to AI. When Presshouse answers or places a phone call for you, it tells the caller it is an AI assistant and that the call is recorded. Don't set it up, in any channel, to claim to be a person.
- Output rights. As between you and us, you own the output made for you. Similar output may be produced for others, and we make no promise that output is unique or free of third-party rights.

Acceptable use
You agree to follow our Acceptable Use Policy. In short, don't use Presshouse to break the law, to harm, deceive or harass anyone, to send unwanted messages, to infringe others' rights, or to attack or overload the service.
Websites and apps you publish
When you publish a website or app made with Presshouse:
- you are the publisher and are responsible for its content, its claims, and the legal pages and consents it shows its visitors (we provide starting templates, which you should review for your business);
- your site's visitors are your visitors, and our Data Processing Addendum covers the information we process about them for you;
- we may remove or disable content that is unlawful, infringes someone's rights or breaks our Acceptable Use Policy, and we will tell you when we do.
Copyright complaints. If you believe content published with Presshouse infringes your copyright, send a notice to support@presshouse.app with: your contact details; the work you believe is infringed; the link to the content; a statement that you believe in good faith the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and you are authorized to act; and your signature. We respond under the Digital Millennium Copyright Act, including counter-notices, and we close the accounts of repeat infringers.
Third-party services
Presshouse works with services run by other companies, such as email, calendars, messaging, payment and advertising platforms. When you connect one, you authorize us to exchange information with it as you direct, and that company's terms govern your use of its service. We are not responsible for services we do not run.
Our intellectual property
Presshouse, its software, designs, documentation and trademarks belong to Intentionally Creative LLC and our affiliates and licensors, including InStoreAdvisor Inc.. Subject to these terms we give you a limited, non-exclusive, non-transferable right to use the service for as long as your account is active. Don't copy, modify, reverse engineer or resell the service, or use it to build a competing product.
Suspension and ending your account
- You can stop using Presshouse and close your account at any time.
- We may suspend or close your account if you break these terms or our Acceptable Use Policy, if you don't pay, or if we must to protect people, the service or the law. Where reasonable, we tell you first and give you a chance to fix the problem.
- Your data afterward. For 30 days after an account closes you can ask us for an export of your content. After that we delete it as our Privacy Policy describes.
Disclaimers
We work hard to make Presshouse accurate, secure and available, but we provide it "as is" and "as available". To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the service will be uninterrupted or error-free, or that AI output will be correct. Some places do not allow these disclaimers, so they may not apply to you.
Limitation of liability
To the fullest extent the law allows:
- neither party is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, even if told they were possible;
- our total liability for all claims relating to Presshouse is limited to the greater of the amount you paid us for Presshouse in the 12 months before the claim and US$100.
These limits do not apply to liability that cannot be limited by law, such as for fraud, gross negligence or willful misconduct, or to your payment obligations or your indemnity below.
Indemnity
If you use Presshouse for a business, you will defend and indemnify us against third-party claims arising from your content, the messages you send through the service, or your breach of these terms or the law, and pay the resulting costs and damages. We will tell you promptly about any such claim and let you control the defense.
Governing law and disputes
These terms are governed by the laws of the State of New York, United States, without regard to its conflict-of-laws rules. Before filing a claim, please contact us at support@presshouse.app so we can try to resolve it; we will respond within 30 days. If we can't, either party may bring the claim in the state and federal courts located in Onondaga County, New York, and both parties consent to their jurisdiction. Either party may also bring an individual claim in small claims court where it qualifies.
If you are a consumer, you keep any rights the laws of the place you live give you that cannot be waived by contract, including the right to bring a claim in your local courts where those laws allow it.
Changes to these terms
We may update these terms. We change the date at the top, and for a material change we give you at least 14 days' notice by email or in the app before it takes effect; if you don't agree, you can stop using Presshouse and close your account before then. Changes don't apply to disputes that arose before they took effect.
General
- Entire agreement. These terms, together with the policies they link to and any order form or written agreement we sign with you, are the whole agreement about their subject. A signed written agreement governs where it conflicts with these terms.
- Assignment. You may not transfer these terms without our consent. We may transfer them to an affiliate or to a successor in a merger, acquisition or sale of assets.
- Events outside our control such as outages of networks or providers, natural disasters or government action excuse delays they cause.
- Severability and waiver. If a provision can't be enforced, the rest still applies. Not enforcing a provision is not a waiver of it.
- Notices. We send notices to the email address on your account or post them in the app. Send notices to us at support@presshouse.app with a copy to Intentionally Creative LLC, 4465 E Genesee St., Syracuse, New York 13214, United States.
- Export laws. Don't use Presshouse where US export or sanctions laws forbid it.
